ByGreg LLC – Terms of Service

1. Acceptance of Terms:

By accessing or using the website development and marketing services provided by ByGreg LLC (“ByGreg,” “we,” “us,” or “our”), including but not limited to website development, hosting, marketing, and related services (collectively, the “Services”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use our Services.

2. Services Provided:

ByGreg LLC provides the following services:

  • Website Development: Creating and designing websites according to Client specifications.
  • Website Hosting: Hosting Client websites on our servers.
  • Marketing Services: Providing digital marketing services, including but not limited to SEO, social media marketing, and content marketing.
  • Website Maintenance and Support: Providing ongoing maintenance, updates, and support for Client websites.
  • Analytics: Utilizing analytics tools to track website traffic and user behavior.
  • Payment Tracking: Utilizing WPmuDev.com for login and payment tracking.

3. Client Responsibilities:

  • You are responsible for providing accurate and complete information required for the provision of our Services.
  • You are responsible for obtaining all necessary permissions and licenses for any content you provide to us, including text, images, and other media.
  • You are responsible for maintaining the security of your login credentials.
  • You agree to comply with all applicable laws and regulations regarding your use of our Services.
  • You are responsible for the content you upload to your website.

4. Payment and Billing:

  • You agree to pay all fees associated with the Services as outlined in your service agreement or invoice.
  • Payment terms will be specified in the service agreement or invoice.
  • Late payments may be subject to interest or other penalties.
  • We use WPmuDev.com for payment tracking, and you agree to their terms of service regarding payment processing.

5. Website Hosting and Maintenance:

  • ByGreg LLC will provide reasonable hosting services to ensure website availability.
  • We will perform regular maintenance and updates to ensure website security and functionality.
  • We are not responsible for website downtime caused by factors beyond our control, such as server outages or internet disruptions.
  • Unless a service through ByGreg LLC is purchased the client is responsible for backing up their own website content. While ByGreg LLC will do it’s best to keep backups, it’s not guaranteed.

6. Intellectual Property:

  • You retain ownership of the content you provide to us.
  • ByGreg LLC retains ownership of any custom code, designs, or other intellectual property we create for you, unless otherwise specified in a separate agreement.
  • ByGreg LLC retains the right to use any general code developed for one client on other client sites.

7. Analytics and Data Collection:

  • We use analytics tools to collect data about website traffic and user behavior.
  • This data is used to improve our Services and provide insights to our Clients.
  • We will handle your data in accordance with our Privacy Policy.
  • We use WPmuDev.com for login and payment tracking, and you agree that they will collect your data as well.

8. Termination:

  • Either party may terminate the Services with 30 days written notice.
  • ByGreg LLC may terminate the Services immediately if you breach these Terms or fail to pay fees.
  • Upon termination, you are responsible for paying any outstanding fees.
  • Upon termination, all outstanding fees bay be billed to the debit/credit card on file.
  • Upon termination and all outstanding fees and bills have been paid ByGreg LLC will provide the client with a website backup.

9. Limitation of Liability:

  • ByGreg LLC will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our Services.
  • Our liability is limited to the amount you paid for the Services. 

10. Indemnification:

  • You agree to indemnify and hold ByGreg LLC harmless from any claims, damages, or expenses arising from your use of our Services or your breach of these Terms.

11. Governing Law:

  • These Terms will be governed by and construed in accordance with the laws of Texas .

12. Changes to Terms:

  • ByGreg LLC reserves the right to modify these Terms at any time.
  • We will notify you of any changes by posting the updated Terms on our website.
  • Your continued use of our Services after any changes constitutes your acceptance of the new Terms.
